Terms of Service

These Terms of Service ("Terms") govern your use of the website at newcastlensw.com.au and the services offered through it (the "Service"). The Service is operated under the registered business name Newcastle NSW (ABN 80 278 683 930) ("we", "us", "our"). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. What NewcastleNSW is

NewcastleNSW is an online directory that helps people find businesses in the Newcastle, NSW region. Listings are provided for general information only. We are not a party to any transaction, agreement or dealing between you and any business listed on the Service, and we do not provide the goods or services offered by those businesses.

2. Business listings

Some listings are compiled from publicly available sources, and some are provided or claimed by the businesses themselves. We do not verify, endorse, or guarantee the accuracy, completeness or currency of any listing, and inclusion in the directory is not a recommendation. Details such as contact information, opening hours and services can change without our knowledge.

If you own or represent a business, you can claim your listing to manage it, and you can ask us to correct or remove it. Contact us at hello@newcastlensw.com.au.

3. Enquiries

When you submit an enquiry through the Service, your details and message are sent to the business you selected so they can respond to you. We do not control how that business uses your information or whether or how it responds. Any resulting dealings are between you and that business.

4. Accounts

To claim and manage a listing you need an account. You are responsible for keeping your login secure and for the information you provide. You must give accurate information and keep it up to date, and you must not use the Service to impersonate another business or person.

5. Premium subscriptions and payments

We offer paid premium listings on a subscription basis. Payments are processed securely by our payment provider, Stripe. We do not store your card details.

• Prices are shown in Australian dollars (AUD) and are billed monthly or annually as you select.
• Subscriptions renew automatically at the end of each billing period until cancelled.
• You can cancel at any time through the billing portal. Your premium features continue until the end of the period you have already paid for, and it will not renew after that.
• Except where required by the Australian Consumer Law, payments already made are non-refundable, including for partial billing periods.
• We may change our prices from time to time. Any change will apply from your next billing period, and we will give you reasonable notice.

6. Acceptable use

You must not use the Service unlawfully or in a way that harms it or others. In particular, you must not scrape, harvest or bulk-download the directory data, attempt to gain unauthorised access, upload false, misleading or unlawful content, or use enquiry forms or listings to send spam.

7. Intellectual property

The Service, including its design, text, and compiled directory, is owned by us or our licensors and is protected by law. You may use the Service for its intended purpose but may not copy or reproduce substantial parts of it without our permission.

8. Disclaimers and liability

The Service is provided on an "as is" basis. To the maximum extent permitted by law, we exclude all warranties not expressly stated in these Terms, and we are not liable for any loss arising from your use of the Service or from your dealings with any listed business.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, it is limited to resupplying the relevant service or paying the cost of having it resupplied.

9. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on this page, with the "last updated" date shown above. Continuing to use the Service after a change means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
